Use the machine. Respect the network.

These terms are a binding agreement between you and WarpMetal for the website, API, VPS capacity, and related services. They combine our terms of service, acceptable use policy, and concise privacy notice.

By creating an order, submitting or authorizing an initial or renewal payment, accessing a server, or allowing an agent to do so for you, you agree to these terms.

01 / Agreement and authority

Who accepts these terms.

You must be at least 18 years old and legally able to enter a contract. If you act for a company, customer, wallet owner, or other organization, you represent that you have authority to bind it. An automated agent may accept and perform these terms only under authority granted by its operator; the person or organization operating it remains the customer and is responsible for its actions.

These terms apply to every order, 30-day service term, renewal, server, authorized user, and workload. The live order and HTTP 402 challenge control the specific plan, price, payment asset, network, recipient, and term. If a live order conflicts with this page, the live order controls only those transaction details.

02 / Acceptable use

What you cannot do with a WarpMetal VPS.

You may use the service for lawful workloads that do not harm people, systems, networks, our suppliers, or other customers. The following uses are prohibited whether performed directly, through software, or by anyone you allow to use the server.

Illegal activity or harmful content

Do not use the service to violate any law or regulation, facilitate crime, exploit or endanger children, distribute non-consensual intimate material, threaten or incite violence, promote unlawful hate, harass others, or violate another person’s privacy or publicity rights.

Fraud, deception, and impersonation

Do not run phishing, credential theft, scams, fraudulent offers, deceptive promotions, impersonation, payment fraud, or services designed to mislead people about identity, origin, affiliation, or purpose.

Malware and unauthorized access

Do not create, host, distribute, or control malware, ransomware, botnets, spyware, destructive code, or tools intended for unauthorized access. Do not access accounts, data, devices, systems, or networks without permission, or intercept or covertly collect data.

Scanning and security testing without permission

Do not probe, scan, test, or attempt to bypass security or authentication on a system or network unless you have clear authorization from its owner and your activity does not endanger our service, suppliers, or other users.

Network attacks and interference

Do not launch, coordinate, enable, or become the target of denial-of-service activity; flood, overload, mail-bomb, crash, or disrupt a service; operate an amplification attack; forge packet headers; spoof traffic; or interfere with another user, host, or network.

Spam and abusive messaging

Do not send or enable unsolicited bulk messages, unlawful commercial email, malicious email, forged email, open relays, or other messaging likely to generate abuse complaints or network blocklisting.

Intellectual property and regulated activity

Do not infringe copyrights, trademarks, trade secrets, licenses, or other rights. You are responsible for all software and content you install and for any permits, codes, or rules that apply to regulated activities such as gambling, financial services, or export-controlled work.

Sanctions, false information, and evasion

Do not use the service in violation of trade or sanctions laws, provide materially false purchaser information, use a stolen or unauthorized payment method, conceal responsibility for abuse, evade a suspension, or obtain service you are not entitled to use.

Dangerous and excessive use

Do not use the service where its failure could reasonably cause death, serious injury, or severe physical or environmental damage. Do not impose abnormal loads that threaten shared infrastructure, support operations, network integrity, or service for others.

Our datacenter, network, IP, software, payment, and infrastructure suppliers may impose additional restrictions. You agree to follow them when they apply. If an upstream rule is stricter, or a supplier requires action to protect its service, we may enforce that rule or request to the extent necessary to continue providing the service.

03 / Customer responsibility

You are responsible for the server and everyone using it.

You are responsible for your content, software, traffic, workloads, agents, employees, contractors, customers, and other users. If you give access to anyone else, you must ensure they follow these terms. Their activity is treated as yours. You must respond promptly to abuse, security, legal, or operational notices and provide accurate information reasonably needed to investigate them.

You retain your rights in your data. You grant WarpMetal and its service providers the limited rights needed to transmit, store, process, secure, and remove that data to provide the service, enforce these terms, and comply with law. You must have all rights and permissions needed for data you place on the service.

04 / Enforcement and reports

We may act to protect the service.

We may investigate complaints and, where reasonably necessary, inspect relevant service metadata or content as permitted by law. We may remove or block content or traffic, restrict ports or features, quarantine a server, suspend service, or terminate service when we reasonably believe there is a violation, a security threat, unlawful activity, material risk to others, or a valid request from a supplier or authority.

We will try to give notice and an opportunity to correct a problem when practical. We may act immediately and without advance notice for serious abuse, urgent threats, repeat violations, fraud, legal requirements, or supplier/network protection. We may preserve evidence, cooperate with lawful process, and report suspected unlawful activity. Suspension or termination for a violation does not create a refund or service credit, and you are responsible for reasonable costs or claims caused by your violation.

05 / Service, payment, and expiration

Each purchase is a fixed, prepaid term.

An initial payment purchases the period shown in the live checkout, currently 30 days. Payment is due in advance and is final once settled, except where a refund is required by law or WarpMetal chooses to issue one. There is no automatic charge: a renewal requires another explicit payment, which may be made by an authorized agent operating within your limits.

Service begins when provisioning starts and may take time to become ready. Inventory, IP addresses, routing, locations, hardware, suppliers, software images, features, and capacity may change. An assigned IP address or identifier is licensed for the service term and is not your property. Taxes and fees imposed on your use or purchase are your responsibility unless the live checkout states otherwise.

If a server is not renewed by its stated end time, we may stop it, deprovision it, reassign its addresses, and permanently delete its data without a recovery period. You may stop using a server early, but unused time is not refundable. We may perform planned or emergency maintenance and may change or discontinue a feature or service when reasonably required by security, law, availability, or a supplier.

06 / Data, access, and security

Keep your own backups and secure your workload.

The VPS is customer-managed. You are responsible for system administration, patches, application security, encryption, access control, SSH and recovery credentials, monitoring, redundancy, and tested backups stored outside the VPS. WarpMetal does not provide a backup or disaster-recovery service unless a separate written order expressly says so.

Keep private keys, wallet credentials, owner tokens, and access tokens confidential. Notify us promptly if you believe the service or a credential has been compromised. WarpMetal does not need and will not ask for a wallet seed phrase, wallet private key, or the SSH private key corresponding to a public key submitted with an order.

07 / Concise privacy notice

Data we handle to run the service.

We may process order and server details, submitted SSH public keys, IP addresses, payment transaction metadata, optional contact information, support and notification records, API and service logs, and security or abuse signals. We use this data to provide and secure the service, process and reconcile payments, communicate with you, prevent fraud and abuse, troubleshoot failures, improve reliability, and comply with legal obligations.

We may share data as needed with infrastructure, network, payment, email, security, and professional service providers; with a successor in a business transaction; or when required by law or reasonably necessary to protect rights, safety, or the service. We retain data only as long as reasonably needed for these purposes, dispute and fraud prevention, security, accounting, and law. Public blockchains independently retain transaction data according to their protocols.

You may request access, correction, or deletion of personal information by contacting us. Rights and exceptions depend on applicable law, and we may verify the request and retain data that we are legally permitted or required to keep.

08 / Warranty, liability, and indemnity

The service is provided as available.

To the fullest extent permitted by law, the service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free operation. WarpMetal does not warrant third-party networks, infrastructure, software, payment systems, or blockchains. The service is not designed for high-risk use.

To the fullest extent permitted by law, WarpMetal and its suppliers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, business, goodwill, or use; or lost, corrupted, or inaccessible data. Aggregate liability arising from an affected service will not exceed the amount you paid WarpMetal for that service during the 30-day term in which the event occurred. Nothing in these terms limits liability or rights that cannot lawfully be limited.

You will defend, indemnify, and hold harmless WarpMetal, its affiliates, suppliers, and personnel from third-party claims, losses, liabilities, and reasonable costs arising from your content, workloads, users, violation of law or these terms, or infringement of another person’s rights.

09 / Changes and general terms

The current version applies to new purchases and renewals.

We may update these terms by publishing a revised version and effective date. A revision applies to purchases and renewals made on or after that date; material changes do not alter an already-paid term unless required by law, security, or an upstream provider. Continuing to use the service in a later term means accepting the then-current version.

If part of these terms is unenforceable, the rest remains in effect. Failure to enforce a term is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a reorganization, financing, sale, or transfer of the service. These terms and the applicable live order are the entire agreement for the service unless we sign a separate written agreement with you.

Before starting a formal dispute, send a written description of the issue and requested resolution to our legal contact and allow 30 days for an informal resolution. This requirement does not prevent either party from seeking urgent protective relief.

10 / Contact and notices

Report abuse or send a legal notice.

Send abuse reports, privacy requests, copyright notices, and legal notices to [email protected]. Include the relevant WarpMetal server ID or IP address, the type of issue, supporting evidence, and a reliable way to contact you. Do not include private keys, seed phrases, or unrelated sensitive data.

This public version is intended for WarpMetal’s standard self-service VPS. A separately signed enterprise agreement may replace or supplement it.
